myPeer User Agreement

This User Agreement ("Agreement" or "Terms of Service") constitutes a legally binding contract between you, an individual registered medical practitioner in India, and Cover-Prime Technologies Private Limited brand name (My Peer) a company incorporated under the Companies Act, 2013, having its registered office at Plot No. 45, Sector 44, Gurugram, Haryana - 122003 (hereinafter referred to as "myPeer", "Company", "we", "us", or "our"). This Agreement governs your access to and use of the website mypeer.in, its subdomains, and any associated mobile applications, services, or tools (collectively, the "Platform"). By creating an account, registering on the Platform, or utilizing any of our services, you explicitly accept and agree to be bound by these terms.

Eligibility and User Verification

Accounts on the myPeer Platform are strictly reserved for Registered Medical Practitioners (RMPs) in India. To eligible to create and maintain an active account, you must hold a valid, active registration with the National Medical Commission (NMC) or any statutory State Medical Council under the National Medical Commission Act, 2019. Access by the general public or patients is strictly limited to viewing public digital cards and published websites without an account. You represent and warrant that you are 18 years of age or older and possess the legal competence to execute this Agreement.

Passwordless Authentication and Account Security

myPeer employs a passwordless authentication model to maximize clinical data security and operational convenience. Your account identity is uniquely mapped to your active Indian mobile number.

  • One-Time Passwords (OTP): Authentication at every sign-in is executed via a time-sensitive OTP transmitted to your registered mobile number. There is no password generated, stored, or recovered.
  • SIM Control: You bear absolute responsibility for maintaining exclusive control of your SIM card and registered mobile number. Any individual with access to your device or SIM can request and receive an authenticating OTP.
  • Misuse Notification: You must immediately notify myPeer customer support at support@mypeer.in if your device or SIM is lost, stolen, or if you suspect any unauthorized access or account compromise.
  • Confidentiality: OTPs must never be shared with third parties. No employee, contractor, or representative of myPeer will ever request an OTP from you under any circumstances.

Authenticity of Professional Credentials

You owe an absolute duty of honesty and transparency regarding all professional information submitted to the Platform. Every credential, including but not limited to your full legal name, professional qualifications, post-graduate specializations, medical council registration numbers, specific state medical council affiliations, years of active experience, and clinic details, must be strictly accurate, verifiable, and exclusively yours. Submitting another practitioner’s credentials, forged certificates, or materially misleading professional information constitutes a material breach of this contract and shall result in immediate account termination and potential reporting to statutory regulatory bodies.

The Verification Framework and the "VERIFIED" Badge

To acquire a "VERIFIED" status badge on the Platform, you are required to upload an official copy of your medical registration certificate. The document undergoes automated Optical Character Recognition (OCR) analysis, cross-referencing inputted parameters against official state or national medical registers. High-confidence matches are approved systematically, while edge cases are queued for manual human audit. Accordingly, you acknowledge and agree to the following terms:

  • Proprietary Nature of the Badge: The "VERIFIED" badge is the exclusive intellectual property of myPeer. Users are granted a limited, non-transferable, revocable license to display the badge solely within the active boundaries of their digital profile. You are strictly prohibited from copying, altering, simulating, or embedding the badge on external third-party materials.
  • Revocation Rights: myPeer reserves the absolute right to revoke the verification badge and suspend or delete the associated account without prior notice if it is discovered that the credentials were misrepresented, the certificate is invalid, or the practitioner's registration has been suspended, cancelled, or expunged by the NMC or any State Medical Council.
  • Watermark Obligations: Upon successful completion of the verification process, this "VERIFIED" blue tick badge shall be automatically appear on your digital card, You are strictly prohibited from attempting to mask, hide, alter, or technologically bypass this watermark..

Content Ownership, Liability, and External Links

You retain full proprietary ownership of the textual, graphical, and hyperlinked content you deliberately publish to your profile, including professional biographies, clinical facility photographs, case galleries, and external integrations (e.g., hospital booking engine pages, social media communication profiles, digital maps). You are entirely and exclusively liable for all consequences associated with your content. While myPeer runs automated protocols to validate link formatting, we accept zero liability for the external destination's actual content. You explicitly covenant not to publish any content that is unlawful, defamatory, deceptive, patient-identifying without written clinical consent, or constitutes prohibited public medical advertising under the Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations or prevailing NMC ethics codes.

Subdomain Provisions and Domain Lifecycle Management

Upon registration, you may select a unique personal subdomain under our master domain infrastructure (e.g., dr-name.mypeer.in) to serve as your digital identity environment.

  • Immutability: The chosen subdomain is entirely immutable and non-editable for the entire duration that your account remains active. It cannot be expropriated or modified by third parties.

  • Quarantine and Recycling: Upon permanent account deletion, the respective subdomain is released and entered into a mandatory 90-day isolation quarantine pool to serve as an impersonation guard. Following the expiry of this 90-day window, the string becomes available to the general registration pool for acquisition by other eligible practitioners. A recycled subdomain carries zero historical goodwill, identity endorsement, or past practitioner association. Temporary unpublishing of a website does not release the subdomain from your possession.

  • QR Code Persistence: Printed physical QR codes generated by the Platform encode a permanent, unique account identifier rather than a transient text URL. Consequently, a QR code printed by a historic account holder will never resolve to a subsequent holder of a recycled subdomain string.

  • Anti-Squatting Restrictions: You must choose a subdomain reasonably reflecting your own clinical practice or legal name. Subdomains that deliberately squat on trademarked terms, institutional entities, brands, or another individual's distinct professional identity are strictly prohibited. myPeer retains administrative rights to unilaterally reclaim any subdomain violating this anti-squatting protocol with a 7-day electronic notice period.

Immediate vs Controlled Publishing Mechanics

The Platform bifurcates the publishing mechanics for optimal user autonomy. Your standardized digital card publishes instantly upon account instantiation (subject to the unverified watermark constraints defined in Section 4). Conversely, your customizable personal website remains strictly private and unindexed until you explicitly execute a "Publish" action within your administrative dashboard. You retain an unconditioned right to "Unpublish" your site at any given time, restoring its state to absolute privacy instantaneously.

Peer Referrals and Fair Use

The Platform offers a professional referral architecture allowing you to invite medical peers via a tracking link. Referral credit allocations are explicitly contingent upon the invited peer successfully completing the full verification workflow. Simple account initialization or signup creates no financial or platform rewards. The use of automated bulk distribution platforms, spam indexing, or fake account creation to farm referral credits is strictly prohibited and immediately voids all accumulated ledger balances.

Educational Entertainment ("My Lounge")

The interactive medical quizzes, case scenario structures, and content hosted within the "My Lounge" section are designed exclusively as educational entertainment for certified professionals. They do not constitute official clinical diagnostic guidelines, formal peer-reviewed medical advice, or accredited Continuing Medical Education (CME) units. You are strictly forbidden from relying upon My Lounge performance metrics or answers for formal patient care decisions.

Mirroring of Policy Documents ("My Membership")

If an active health cover policy underwritten by CoverPrime is programmatically matched to your verified mobile number, the Platform provides a read-only convenience mirror of that coverage dashboard. The official records, schedules, and policy wordings maintained directly by CoverPrime remain the sole authoritative source of truth. The display on myPeer creates no independent legal rights, warranties, or specific additions to coverage scope.

Disclaimer of Warranties and Limitation of Liability

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR UNINTERRUPTED AVAILABILITY. TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE INDIAN LAW, IN NO EVENT SHALL COVERPRIME TECHNOLOGIES PRIVATE LIMITED, ITS DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE PLATFORM. THE TOTAL AGGREGATE LIABILITY OF THE COMPANY FOR ANY CLAIMS ARISING UNDER THIS AGREEMENT SHALL BE STRICTLY CAPPED AT THE FEES ACTUALLY PAID BY YOU TO THE COMPANY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR INR 5,000, WHICHEVER IS HIGHER.

Suspension, Deletion, and Termination Ladder

We reserve the right to administratively enforce penalties against accounts breaching these terms. Enforcement follows the proportional ladder detailed in the Community Guidelines (comprising warnings, temporary profile concealment, and verification badge removal) but may step directly to immediate and permanent account termination in cases involving verified fraud, legal necessity, or systemic professional impersonation. Users can request account deletion at any time; the final deletion and purging of data follow a strict 30-day structural window as mandated by our Privacy Policy.

Modifications to the Agreement

myPeer reserves the right to amend this User Agreement at any time. In the event of material structural changes, you will receive an active notification inside your dashboard or via electronic mail at least fourteen (14) days prior to the enforcement of the revised terms. Continued utilization of the Platform following the conclusion of the notice period constitutes active consent to the updated terms.

Governing Law and Dispute Resolution

This Agreement shall be governed by, interpreted, and construed strictly in accordance with the laws of the Republic of India. Any dispute, controversy, or claim arising out of or relating to this contract, including its formation, breach, or termination, shall be referred to and finally resolved by binding arbitration under the Arbitration and Conciliation Act, 1996. The dispute shall be submitted to a sole arbitrator mutually appointed by the parties, or failing agreement, appointed in accordance with the rules of the Act. The seat and venue of the arbitration shall be New Delhi, India, and the language of the proceedings shall be English. Subject to the arbitration framework, the courts at New Delhi shall hold exclusive territorial jurisdiction over any residual judicial interventions.
